U.S. District Chief Judge Vaughn Walker ruled that gays and lesbians marriages should resume immediately in the state of California.
On August 4th, Walker ruled that Proposition 8 was unconstitutional and overturned the same-sex marriage ban. The verdict pertains to the federal court case on the constitutionality of California’s anti-gay ballot initiative – Proposition 8.
The 2008 ballot initiative rescinded the then-existing right of gay and lesbian families to enter into legal marriage by amending the California state constitution. The case against Proposition 8 is based on the argument that the ballot initiative violates guarantees in the U.S. Constitution. The verdict, is expected to be appealed no matter how Judge Walker rules. Proposition 8 is widely expected to make its way to the Supreme Court.
