Sgt. Jeffrey Cotton, a white police officer of the Bellaire Police Department was found not guilty in Houston, Texas for shooting and killing Robert Tolan, a 23-year-old Black or African American man. Robert Tolan was forced to lie face down before he was shot.
Cotton’s lawyer had argued that the sergeant felt his life was in danger when he shot Robert Tolan in the driveway of the young man’s family home. The shots from Cotton’s gun punctured Tolan’s lung and damage his liver.
Sergeant Cotton and his partner forced Tolan and his cousin to lie face down on the ground at gunpoint after the young men had gotten out of their car in front of Mr. Tolan’s house. According to Cotton’s lawyer, “The officers mistakenly believed that the car had been stolen and that Mr. Tolan had a weapon.”
Robert Tolan is the son of Bobby Tolan, a former Major League Baseball player. The Tolan family filed accusing the community and police of having a history of racial profiling, false arrests and racial harassment.
The Bellaire Police Department has been accused of stopping black and Hispanic motorists that pass through the city more often than it stops whites, an accusation the city strongly denies.
